CORRECTIVE NOTICE BY SIRIUS XM CANADA INC.
RE: Unsolicited Telecommunications by Sirius XM Canada Inc.
The Canadian Radio-television and Telecommunications Commission (“CRTC”) has informed Sirius XM Canada Inc. (”SXMC”) that a number of calls made to Canadian consumers initiated between 1 August 2012 and 6 January 2015 constituted violations of the Unsolicited Telecommunications Rules (the Rules) made by the CRTC pursuant to section 41 of the Telecommunications Act. Specifically, calls were made on behalf of SXMC to consumers who were registered on the company’s do not call list and/or without specifying all requisite information at the beginning of the call.
In recognition of the CRTC’s concerns and because of SXMC’s cooperation and commitment to ensuring compliance with the Rules, SXMC has voluntarily agreed to, amongst other things, pay an administrative monetary penalty and implement enhancements to its comprehensive compliance program to ensure that such violations do not occur in the future.
