Summary of Privacy Policy

Your privacy is important to Sirius XM Canada Inc. (referred to as “SiriusXM”, “we”, “our” or “us”). This Privacy Policy describes the types of information we may collect from you or others, or that you may provide when you use our Services and Sites, and explains how we collect, receive, store, use and disclose your personal information, and applies to your use of SiriusXM’s Sites and Services. In this Privacy Policy, certain terms (such as “Services”) have a specific meaning that is explained in the Definitions section below.

The following is a summary of what information we collect, and how we collect, use, and disclose personal information. For a full description of any of our practices relating to personal information, please read this Policy in its entirety. This Policy Applies to All Uses of Our Services and Sites

You agree to the terms of this Privacy Policy (including as amended from time to time) whenever you:

  • sign up for or use our Services
  • use or visit our Sites (including siriusxm.ca)
  • purchase or lease a SiriusXM satellite radio or a vehicle that includes a SiriusXM satellite radio
  • use SiriusXM Streaming through our mobile and browser-based apps and players
  • use Enabled Radios or any other technology through which our Services can be accessed such as third-party hardware for the home
  • use any other sites, players, widgets, tools, applications, data, software, APIs and other services provided by SiriusXM

If you do not agree to the terms of this Privacy Policy, please do not use the Sites or purchase, order, or use our products or Services.

Information We Collect and Receive

We collect information directly and also receive certain information from others. Generally speaking, we collect and receive address information, payment information, certain limited technical information to provide you with Services, demographic and marketing information, usage information, voice information, and location information. More details are provided below.

The types of information we collect or receive depends on the particular product or Service we provide to you, or how you choose to interact with us, or a retailer of our SiriusXM satellite radios, or an automaker or dealer selling or leasing SiriusXM satellite radio equipped vehicles. For example, when you purchase or lease a SiriusXM satellite radio or a SiriusXM satellite radio equipped vehicle, or obtain a trial of our Services, we collect and receive certain basic information allowing us to contact you, market to you, and provide you Services. If you subscribe to a paid Service, we will also collect transactional information. If you contact us with a customer service issue, we will use the information you share with us to provide you with support. If you use our Services, certain location and usage information must be collected to comply with copyright laws.

Similarly, when you use our Sites, we may collect limited information from you through cookies or other technologies to better understand you, to market to you, and make our offerings more relevant to you, and to help you more easily navigate and use our Sites. Likewise, if you use social media, we may receive certain information you make available pursuant to your platforms’ terms of service and privacy policies.

How We Use Your Personal Information

We use your personal information to:

  • offer and improve the Services
  • operate the Services and Sites
  • provide support to you
  • improve the security of the Services and Sites
  • identify, diagnose and address technical issues
  • comply with legal requirements such as geographical restrictions over our offering of content
  • better understand you and to make special offers to you or otherwise market to you
  • protect the rights and property of SiriusXM, our customers, employees, and the public
  • create anonymized information that does not identify you personally
  • carry out activities that are required or permitted by law

Use of Information by Service Providers

We engage Service Providers who access and use your personal information to the extent necessary to perform various services on our behalf. For example, a Service Provider may be asked to perform credit card processing services, analyze our data for better insights on customers, help advertise our Services, administer a contest, deal with customer inquiries, fulfill administrative functions, or help us better serve you, including by notifying you of special programs regarding products or Services that may be of interest to you. We also may use a Service Provider to host one or more of our Sites, process and store data, or fulfill technology-related functions on our behalf. Certain automakers and dealers also act as Service Providers by marketing our Services on our behalf. If we transfer your information to Service Providers for processing, they have access to that information only to the extent necessary to perform the functions they carry out on our behalf, are not permitted to use it for other purposes, and are bound to keep the information strictly confidential.

Information that We Disclose

We may disclose your information that we collect, receive or that you provide as described in this Privacy Policy to other persons:

  • when permitted or required to by law
  • to enforce our Customer Agreement
  • to protect the rights, property or personal safety of SiriusXM, its customers, employees or other members of the public
  • to detect, prevent, or otherwise address fraud, security, safety, or technical issues
  • with our Affiliates for research, analysis, and product development purposes
  • on an anonymized or aggregated basis so that it does not identify you personally to the public or our partners
  • on a pseudonymous basis to ad servers and platforms
  • in association with a potential loan, financing, security, licensing or lease arrangement, or any merger, acquisition or asset licensing sale
  • to marketing partners (such as automakers)
  • where you have consented to another kind of disclosure

In this section, we also address the consequences of social media usage and describe our standards for your making available of User Content.

Your Choices

You may opt out of, or opt-in to, certain uses of your personal information that are not required for us to provide the Sites and Services. For example, you may call us at 1-888-539-7474 or email us at care@siriusxm.ca to ask us to stop marketing to you via telephone, e-mail, electronic message, and letter mail. In some instances, it may take up to fourteen (14) days to process requests. Also, please note that even after opting out from marketing communications, you may receive other communications from us as permitted by applicable law, such as a legal notice.

Certain third-party tools are available to ask advertising networks not to track you across websites or apps.

You may not opt out of any use or disclosure of your personal information that is required for us to provide the Sites and Services without also discontinuing your use of the Sites or Services. For example, you may not disable the collection of Listener Usage Data or Vehicle Radio Usage, as such data is necessary for SiriusXM to fulfil its reporting obligations under various copyright tariffs. Likewise, Rough Location data is needed to ensure that content is appropriately licensed where you are.

Storage of Personal Information

We (and our Affiliates and Service Providers) store personal information in Canada and in the United States, where it may be subject to disclosure under applicable laws. We list countries where your personal information may be accessed by our Service Providers below.

To help protect the confidentiality of personal information, we use safeguards appropriate to the sensitivity of the personal information being protected. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure, and it may be possible for third parties to intercept or access information unlawfully. We cannot guarantee the security of your or any other person’s information.

We may retain your personal information for a limited period of time after you cease using our Sites or Services for purposes of internal account management, to resolve disputes, enforce our Customer Agreement, technical and legal requirements and constraints related to the security, legal compliance, integrity and operation of the Sites and the Services.

Changes to this Privacy Policy

SiriusXM reserves the right to modify or supplement this Privacy Policy statement at any time by providing you with notice of the change. We describe how we provide notice below.

Jurisdiction

The Services and Sites are intended for use in Canada only and SiriusXM is a federally regulated entity in Canada. Accordingly, this Privacy Policy is intended to comply with and should be interpreted in accordance with the federal privacy laws of Canada.

This Policy Applies to All Uses of Our Services and Sites

You agree to the terms of this Privacy Policy (including as amended from time to time) whenever you:

  • sign up for or use our Services
  • use or visit our Sites (including siriusxm.ca)
  • purchase or lease a SiriusXM satellite radio or a vehicle that includes a SiriusXM satellite radio

If you do not agree to the terms of this Privacy Policy, please do not use the Sites or purchase, order, or use our products or Services.

1. Information We Collect and Receive

A. Information you give us

When you purchase or subscribe to our Services, obtain a trial of our Services, provide us with your information, contact us for support or information, order items from us, sign up for a newsletter or other marketing communications, or sign up for a contest or promotion, we may collect the following personal information:

  • your name, address, telephone number, and e¬mail address
  • your payment information such as your credit card number and associated information
  • demographic information, including language of preference, referral source, and other marketing information if you agree to provide it
  • any information that you choose to provide to us when you contact us for support or information or complete an online form.

You may also give us personal information when you use the interactive portions of our Sites and Services. Note that any information you post on interactive Sites and Services are often public and can be seen by others. Finally, we may also collect information you give us when we interact with you on social media services such as Instagram, Facebook, TikTok, YouTube and Twitter.

B. Collection via our Sites and Services and the Purpose of Collection

Our Sites and our Services collect the following information automatically:

i. Cookies: When you engage with our Sites or Services, we may store small text files on your device called cookies to automatically recognize you each time you visit. Cookies can help us in many ways, for example, by allowing us to tailor the Sites or Services to better match your interests or to save your password so that you do not have to re-enter it each time. Cookies also help us track visitors, track usage, conduct research, target advertising, and enhance and personalize the Sites and the Services to the interests of users. Session ID cookies are essential to monitoring the performance of the Sites, maintaining security, and making it possible for you to navigate the Sites. A session ID cookie expires when you close your browser and does not reactivate. Other cookies remain on your device for a period of time.

You can remove cookies by following directions provided in your browser’s “help” file to erase cookies from your device, block all cookies, block certain types of cookies, or receive a warning before a cookie is stored on your device. If you prevent a cookie from being sent and stored on your device, you may limit the functionality of the Sites and Services, including entering your password, setting your favorite channels, storing items in your shopping cart, or entering sweepstakes or contests.

We may also allow our business partners to place cookies on the Sites and Services for the purposes listed above, including Google Analytics cookies to track activity related to our Sites and Services, to conduct research, and to display relevant advertising on other sites. You can opt-out of Google Analytics across most leading browsers by installing the utility available at the following link:

We use external ad-serving companies to serve ads to you when these companies identify that you are in a given geographic location. The information that such agents collect and share with us is pseudonymous.

ii. Pixel Tags: We may collect information related to advertising through the use of pixel tags. A pixel tag is a small graphic which is loaded when a user visits a website or opens an email. It helps us better understand user behaviour and measure conversions. The information collected through this technology is pseudonymous and does not identify you as a particular person.

This information is used as part of the ad-serving process for reporting, and to select and direct the ads you see online. You may learn more about this practice and your choices to limit uses of this pseudonymous information by third-party service providers at networkadvertising.org/choices.

You may choose not to be recognized through pixel tags by adjusting your browser and email settings so that they support external graphics only after you provide permission on a case-by-case basis.

iii. Server Logs: When you use our Sites and our SiriusXM Streaming service, we may also automatically collect and store certain information in server logs to evaluate issues on our website, app, and in our subscription flow process. This may include:

  • domain name of the website from which you came, number of visits, average time spent on the Sites, and the pages you viewed
  • information entered on our webforms
  • details of how you used our Services, such as which channels, shows, or songs you listened to, and when and how long you listened to them
  • device information such as your unique device identifier, device type, web-browser type and version, operating system version, and the version of the SiriusXM Streaming application being used
  • Internet protocol address

iv. Location information: The Sites and SiriusXM Streaming service will determine your location for the purposes of controlling access to certain content using your Internet protocol address, as well as for the purposes of research, analysis, product development and other business purposes. If you are using the SiriusXM Streaming mobile applications, we use GPS signals for those purposes.

  1. Your precise location: The Geo-Location tools on your Enabled Radio identifying your aggregated and anonymized precise location allow us to provide a number of features in our Services for your benefit. Your use of the features may be viewed and collected by us to help personalize your experience with our Services and advertisements. We may maintain your aggregated and anonymized precise location and Rough Location in our databases, so that over time we can better predict and support traffic patterns, and provide suggestions for improved routing, among other things, as well as for analysis of signal outage events. If you do not wish us to collect your precise location, the Geo-Location tools in your Enabled Radio may be disabled in your radio’s SiriusXM System Settings or by other means designated by your automotive manufacturer.If your Enabled Radio has Geo-Location tools, we will provide you with a notice at the Welcome Screen prior to your first use. By choosing “Listen now,” “PROCEED TO USE,” or a similar affirmation, you consent to us having access to aggregated and anonymized precise location data until you take action to disable the Geo-Location tools. If you disable location tools and continue to use our Traffic, Travel Link and related Services while driving, we will be unable to provide you with the optimal functionality of these Services. We also collect the country code from your Enabled Radio to support geographic restrictions on certain IP-delivered content.
  2. Your Rough Location: For Internet-Enabled Devices, our Services will automatically collect information on your device’s Rough Location via IP address, and we may use it to comply with our contractual arrangements which restrict us from sending certain programming channels outside of defined areas, such as when you want to listen to our Streaming service while in another country. We may also use your Rough Location to provide infotainment services to your vehicle if you use such services and to serve up advertisements. You may not disable our collection of your Rough Location.

v. Social Media: From your use of social media applications linked to our Sites, our media player, or our mobile applications, we may also receive your personal information or social media identifier, along with your email address, profile information, interests, likes, and/or other information which we or the social media platform will specify in advance at the point of collection.

vi. Your Voice: We may make a recording or transcript of voice interactions (“Voice File(s)”) if you use a voice feature with our service, such as using your voice to conduct a search on one of our Services. We collect and retain Voice Files in these instances for processing purposes to understand the listener’s query or intent and to return the right experience. These Voice Files are not linked to you or your account. You cannot access Voice Files. Access is limited to our product and engineering employees who require access to Voice Files for business purposes, including debugging to improve the listener experience of making voice queries and to learn more about the resulting action taken by listeners following voice queries.

If we make a Voice File of your voice queries, we may use voice recognition technology owned by Google (or another Service Provider) to process voice requests and text-to-speech. We share this voice data only as described within this Section. Google or a similar Service Provider returns the results back to SiriusXM to provide the content or take the action you have requested. We and Google/Service Provider may also collect and use voice data for the purposes set forth in our respective privacy policies, including quality assurance and to optimize the product and user experience. For more information, please review the Google Privacy Policy and this Policy in detail. If you do not wish for collection of your voice in this way, please do not use our voice features.

viii. No Adobe Flash Player Access to Camera and Microphone, if you use Internet Explorer: If you stream our Services on our online media player while using the Microsoft Edge browser, it will use Macromedia’s Adobe Flash Player. In the Adobe Flash Player Global Privacy Settings menu is a cautionary statement that we may have access to the camera and microphone of your Internet-Enabled Device. The Flash Player advises you that websites such as ours must ask your permission before using your camera or microphone. SiriusXM does not access or use your camera or microphone in any way, even if you select “Allow” in the Adobe Flash Player settings.

ix. QR Codes: We may also collect information about you whenever you choose to interact with one of our ads containing a quick response (“QR”) code or visit a URL.

x. Pseudonymous Information: We automatically receive certain types of information whenever you interact with us through an Internet browser, your mobile device, or through your vehicle’s Enabled Radio. This information is pseudonymous in that it is associated with unique identifiers that cannot identify you directly. The operating system, browser software and Internet service provider you use, and your precise location and/or Rough Location (as set out in the “Location Information” section above) is received by us depending on the equipment you use and the settings you choose to employ.

We collect pseudonymous Listener Usage Data about your interactions with the content you access from Internet-enabled technology you use to access our Services. If your vehicle has an Enabled Radio, SiriusXM and our Service Providers will collect Listener Usage Data and other Vehicle Radio Usage data regarding your use of an Enabled Radio. We are unable to stop the collection of Listener Usage Data or Vehicle Radio Usage from Enabled Radios.

We cannot provide access to, stop the collection of, or delete the Listener Usage Data or Vehicle Radio Usage data which we collect from devices that are not associated with a trial or paying subscriber, or when you are using our Services during our “free listening” periods. If you have a SiriusXM account, we may match your personal information to your Listener Usage Data or Vehicle Radio Usage data to enhance your profile, at which time your Listener Usage Data is no longer pseudonymous and is handled as personal information.
When you set the “Incognito” mode in our mobile applications for streaming, we will continue to collect your Listener Usage Data for your “app” experience; but we will not use or share it for our marketing purposes.

xi. User and household usage of devices: We receive Listener Usage Data automatically from Internet-Enabled Devices. If you have a SiriusXM account, we may match the Listener Usage Data we receive to the device or devices associated with your account and with you or other members of your household. We use this Listener Usage Data along with cookie information to enhance our Services for you, for troubleshooting and research, and for advertising of our Services and the services of third parties. You may use multiple devices to access our Services (one device at a time), such as a vehicle’s Enabled Radio, a smartphone, a laptop, a tablet, a wearable device, or a television. More than one device can be associated with you as a user or with your household. Mobile app opt-outs do not affect cookie-based data, while browser-based opt-outs do not affect mobile app data. Also, mobile app opt-outs are limited to a specific device, while browser-based opt-outs are limited to a specific browser.

C. Information We Receive from Other Sources

i. Automaker and retail partners

We may receive personal information from our automaker, dealer, and retail partners who distribute and sell SiriusXM satellite radios. When you purchase a SiriusXM satellite radio (either as a stand-alone device or integrated into a vehicle), to set up Services for you, our partners collect limited set-up information and share it with SiriusXM. For this reason, we may receive your name, address, telephone number, and whether you purchased or leased the vehicle. In certain instances, we may also receive your email address and demographic information. We also obtain information from resellers of vehicles which include a SiriusXM satellite radio. To allow for a seamless set up, we may also receive information about your vehicle including your SiriusXM satellite radio’s Radio ID or ESN and your vehicle’s VIN, make, and model.

ii. Social media services

The collection and use of your personal information when using a social media service such as Facebook, Instagram, TikTok, YouTube or Twitter is guided by that social media service’s privacy policy and your privacy settings on such service. We may receive information from social media services in accordance with their privacy policies and your privacy settings on those services. Note that any comments that you post on our Facebook, Instagram, TikTok, YouTube, Twitter, and our other social media pages are public and can be seen by others.

iii. Supplemental Information providers

We may supplement the information you provide to us, or which we may obtain from your use of our Services – both personal and pseudonymous – by acquiring commercially available demographic and marketing information from third parties, including marketing data providers and advertising entities.

These third-party companies must follow privacy laws when collecting and sharing the information with SiriusXM. We will only use information provided by third parties in accordance with the consent they represent to us they have obtained.

Disclaimer: We disclaim all responsibility and liability associated with and related to the accuracy, availability, functionality and reliability of third-party notices and choice mechanisms. We expressly disclaim responsibility for the acts and noncompliance of others.

D. For fulfilling legal requirements, or as required or permitted by law

We may collect your information to enforce our Customer Agreement, any other applicable terms and conditions and other agreements to which you or SiriusXM are parties, and to protect the rights and property of SiriusXM, our employees, members of the public, and our partners.

In certain circumstances, SiriusXM may be compelled or permitted by law to collect your information for other purposes, such as for use in an investigation, for use in an insurance witness statement, or for acting in respect of an emergency that threatens the life, health or safety of an individual.

2. How We Use Your Personal Information

A. For our business purposes

We use information we collect from you and receive from others to:

  • offer the Services
  • operate the Services and Sites
  • prevent fraud
  • administer the Services and Sites, including account opening and billing
  • fulfill orders and deliver your purchases
  • improve the security and effectiveness of the Services and Sites
  • personalize your listening experience, provide content recommendations, and navigation of the Sites and Service
  • improve our goods, the Sites, and our Service and to develop new Services
  • provide support to you
  • send you Service-related communications
  • identify, diagnose and address technical issues affecting the Services and the Sites
  • analyze trends and usage patterns of the Services and the Sites
  • provide you with login sessions on the Sites and to remember that you are logged in
  • perform market research and analytics
  • provide you with more relevant advertisements

Location Data: If you use the Services through an Enabled Radio in your vehicle, we may use the anonymized location of your vehicle over time to identify signal reception or other technical issues with the Services, or to better predict and support your traffic patterns and provide suggestions for improved routing. See also “Location Information” section above.

Listener Usage Data: We may use your Listener Usage Data to account for our use of licensed content. This information will be aggregated and supplied to content licensors such that the information is anonymous. We may also use your Listener Usage Data to recommend content.

Anonymization: We may also anonymize your information. Anonymization means rendering your personal information in a form that does not identify you and where you can’t reasonably be re-identified through the use of that information or in combination with other information. Please note that once your information is anonymized, it is generally no longer covered by privacy laws and can be freely used by us or others to gain insights.

Advertising and Offers: We also use your information to better understand you and to provide you with more relevant advertising, including advertising on other sites and offers from third party partners which we believe may be of interest to you. For example, we may offer opportunities or information to you from content providers, such as from musical artists, sports leagues, news, and talk programming providers. We may also send you information and offers on products, services, or opportunities from automakers or retailers of SiriusXM satellite radios or other third-party partners. As described in “Your Choices” below, you may opt out from marketing communications without any impact on your use of the Sites or Services.

On Air: If you provide us with information when you request that a song or other content be played on our Services, we may use the information you provide in accordance with this Policy, including to announce or play your name and request on the air.

Promotions: If you provide your name for a promotional offer or to enter a sweepstakes or contest, and subsequently win a prize, we may post your name on a winner’s list online, and will file your name with provincial agencies if required by law.

B. For fulfilling legal requirements, or as required or permitted by law

We may use your information to comply with legal requirements, such as maintenance and production of certain records in court proceedings or to fulfil a copyright tariff requirement.

We may also use your information to enforce our Customer Agreement, any other applicable terms and conditions and other agreements to which you or SiriusXM may be bound, and to protect the rights and property of SiriusXM, our employees, members of the public, and our partners. When using the SiriusXM Streaming service, we use anonymized location information to enforce content restrictions.

In certain circumstances, SiriusXM may be compelled or permitted by law to use your information for other purposes, such as for use in an investigation, for use in an insurance witness statement, or for acting in respect of an emergency that threatens the life, health or safety of an individual.

3. Use of Information by Service Providers

We may transfer your information for processing to Service Providers that assist us in delivering our Services, with information processors to help us communicate with and better understand our subscribers, and with marketing partners, who market SiriusXM services on our behalf. These third parties have access to your personal information only to the extent necessary to perform the functions they carry out on our behalf. They are not permitted to use it for their own marketing purposes and are bound to keep the information strictly confidential.

We transfer your personal information to Service Providers whom we use to deliver the Services and Service Providers who help us optimize and market our Services. For example, we have partnered with other companies to: provide infrastructure, marketing, information security, and IT services, personalize and optimize our Sites and Services, process credit card transactions, provide customer service and telemarketing, fulfill orders, administer rebates and promotional offers, collect debts, analyze and enhance data, and process consumer surveys. This helps us better understand our subscribers, to improve our marketing, and to communicate more effectively with you.

We may also share your information with our professional Service Providers, such as our external lawyers, accountants, and other professional services advisors who help us run our business and to carry out due diligence to prevent or reduce our commercial risks.

4. Information that We May Disclose to Others

A. For Our Business Purposes

We may disclose your information to other persons in the following general circumstances:

  • when permitted or required to by law
  • to fulfill requests made by you
  • to detect, prevent, or otherwise address fraud, security, safety, or technical issues
  • where a Service Provider reasonably needs that information to improve its services for our benefit

We may share your location data and Listener Usage Data with our Affiliates who may use the data for research, analysis, and product development. We will also share your Listener Usage Data for other business purposes, such as for certain mandatory reporting obligations to copyright collectives.

If SiriusXM is involved in a potential loan, financing, security, licensing or lease arrangement, or any merger, acquisition or asset licensing sale, we may share information with potential purchasers on a confidential basis solely to allow them to assess the business opportunity. In the event such a transaction is completed, SiriusXM will require that your personal information only be used by the counterparty and its affiliates in compliance with this Privacy Policy.

We may disclose your personal information where you have provided your consent either to us or to another person. For example, if you have consented for us to share certain information with your automobile manufacturer or dealer, we may do so. Similarly, if you enter a contest co-sponsored by SiriusXM and another company, its terms may authorize sharing of information between the sponsors. In any such case, where you have consented to a disclosure to another entity, their use and disclosure of your personal information is subject to their privacy policy. We are not responsible for the privacy and security practices or policies of these entities, and we encourage you to learn about their privacy and security practices and policies before providing your consent to such a disclosure.

We may generate and disclose anonymized or aggregated information that does not identify you personally to the public or our partners. For example, we may share anonymized or aggregated statistical information publicly to show trends about the general use of our Sites and Services.

As described in the Collection via our Sites and Services description above, we share your pseudonymous information with ad servers and platforms, advertising agencies and other advertising entities to serve ads on the Sites, on the Services and on third-party websites. The information collected or shared with ad-serving technology is used as part of the ad-serving process for reporting, and to select and direct the ads you see online at the Sites or delivered through the Service. It does not contain your name, address, telephone number or email address.

B. Legal disclosures

We may share personal information with companies, organizations or individuals if we are permitted or required to do so by law. We will disclose your personal information as long as we believe it is reasonably necessary to:

  • comply with any applicable law, regulation, legal process or governmental or regulatory request
  • enforce our Customer Agreement, including investigation of potential violations thereof
  • protect the rights, property or personal safety of SiriusXM, its customers, employees or other members of the public
  • act in respect of an emergency that threatens the life, health or safety of an individual
C. Disclosures associated with social media interactions

If you interact with SiriusXM on social media services such as Instagram, Facebook, TikTok, YouTube and Twitter, we encourage you to consult these services’ terms of service, privacy policies and educational materials so that you understand how these services collect, use and disclose personal information, including with us.

We are not responsible for material submitted to us or posted to the Sites or third-party sites by users through social media or other means (“User Content”). We have no obligation to pre-screen, monitor, review or edit any User Content. We, or our designees, have the right (but not the obligation) in our sole discretion to refuse or remove any User Content that, in our judgment, does not comply with this Policy or is otherwise undesirable, inappropriate or inaccurate. User Content you view, submit or post is at your own discretion and risk, including any reliance on the accuracy, completeness, or usefulness of such User Content. User Content does not necessarily reflect the views of SiriusXM. We may preserve User Content and may disclose User Content if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to (i) comply with legal process; (ii) enforce our Customer Agreement; (iii) respond to claims that any User Content violates the rights of third parties; or (iv) protect the rights, property, or personal safety of SiriusXM, our users or the public.

You agree not to post User Content which is harassing, abusive, vulgar, hateful, defamatory, sexually explicit, inflammatory, profane, racially or ethnically objectionable, religious or political, or that encourages inappropriate or unlawful conduct, or imposes an unreasonable or disproportionately large load on the Sites or otherwise interferes with the Sites, or infringes the rights of any third party. We may, at our sole discretion, immediately terminate your access to the Sites should your conduct fail to conform to this Policy. We do not solicit nor do we wish to receive any confidential, secret or proprietary information or other material through the Sites or mail, or in any other way. Any User Content posted on the Sites or material submitted or sent to us will not be confidential or secret. By posting or sending or otherwise making available any User Content, you represent and warrant that the User Content is original to you and that no other party has any rights to the User Content and you grant us the royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully sub-licensable right and licence to use, reproduce, communicate, make available, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content (in whole or part), including any information, suggestions, ideas, drawings or concepts contained in such material, worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. You are and will remain responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of such User Content.

5. Your Choices

A. Information and uses that we require to provide you with the Sites and Services

You may not opt out of any use or disclosure of your personal information that is required for us to provide the Sites and Services without also discontinuing your use of the Sites or Services.

For instance, you cannot subscribe without providing the necessary billing information.
Likewise, you may not disable the collection of Listener Usage Data or Vehicle Radio Usage from your use of our online media player, our mobile applications, and Enabled Radios, as such data is necessary for SiriusXM to fulfil its reporting obligations under various copyright tariffs, for content recommendations, and for wireless data costs (as applicable).

You also cannot restrict the collection of your Rough Location, which is used to ensure content is appropriately licensed where you are. You may not disable our collection of the pseudonymous mobile device ID for your mobile device; however, you may be able to reset and change your mobile device ID at your discretion through settings located on your own mobile device. Please refer to information provided to you by your mobile device manufacturer.

We may also provide you with Services and account-related announcements despite a “do not contact” request. Notwithstanding the fact that your home telephone and/or mobile telephone number may be listed on a telemarketing Do-Not-Call list, we may use the information you provided to us for Services and account-related notifications. You may not opt out of these non-promotional communications related to your subscriptions or order.

B. Information uses over which you have some control

Marketing: By registering on the Sites, subscribing to our Services, providing your telephone number, email address or postal address to us, or by purchasing or leasing a vehicle with our SiriusXM satellite radio receivers and/or Services included, you agree that this action creates an existing business relationship with us for purposes of all privacy, telemarketing and anti-spam laws. We will therefore reach out to you by telephone, email or mail in connection with the Services. You can contact us to cease all marketing communications.

Choices Relating to Marketing Communications: You may opt-out from, or opt-in to, as applicable marketing communications without any impact on your use of the Sites or Services.

  • You may call us at 1-888-539-7474 or email us at care@siriusxm.ca and ask to unsubscribe from marketing e-mails, direct mail, SMS messaging, or telemarketing. If you ask to unsubscribe from telemarketing, if a calling campaign is in process you may continue to be contacted while your request is processed, so while we strive to accommodate your request within two (2) business days, please allow up to fourteen (14) days for your request to take effect. We may have more than one telephone number for you or your family members, so please be specific as to which numbers you are directing us to not call.
  • To unsubscribe from marketing e-mails, you may also unsubscribe by clicking the “Unsubscribe” link included at the bottom of any marketing email or newsletter from us.
  • To unsubscribe from SMS messaging, you may also unsubscribe by texting “STOP” within the SMS message.
  • Please note that even if you have made a ‘do not contact request’, we may still contact you in circumstances permitted by applicable law, including the sending of legal notices and for certain Service- and account-related matters. We will abide by the Do Not Contact time limits established under Canadian law.

Choices Relating to Online Tracking: Some browsers may transmit “do-not-track” signals to website providers. Given differences in how browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. Not all browsers offer a “do not track” option and there is currently no industry consensus as to what constitutes a “do not track” signal. For these reasons, many organizations, including SiriusXM, do not currently respond to “do not track” signals.

On our Sites, you may be presented with the option to opt out of all cookies except those that are necessary for the functioning of our Sites. Our Sites may allow you to opt out of cookies used for analytics and cookies used for advertising.

However, until a workable universal standard is developed for reflecting user choices, there are other methods you can use to tell third-party online advertising networks about your online tracking choices. The Digital Advertising Alliance (“DAA”) makes tools available for consumers to register their choices not to be tracked by participating advertising networks or companies in the collection and use of your online activities. These are (1) The DAA Consumer Choice Page for Mobile Web (at aboutads.info/choices) and (2) DAA AppChoices (at aboutads.info/appchoices), which is a mobile app that allows you to opt out of the collection and use of cross-app data, other than for permitted uses, by listed third-party AppChoices participants. You can request an opt-out of mobile-app targeted advertising ads from any or all of the listed participating advertising networks. You can download the free mobile app from an app store available on your mobile platform.

Choices Relating to Location Data: As noted above, we cannot disable “Rough Location Data” for legal compliance reasons.

However, if you are using an Enabled Radio to receive Services, the Geo-Location tools on your Enabled Radio identifying your latitude and longitude (your “precise location”) are used to optimize our Traffic, Travel Link and related Services while driving. They are also used to identify signal outage issues with SiriusXM’s network. We also collect a country code from your Enabled Radio to support geographic restrictions on certain IP-delivered content. Radios other than Enabled Radios do not identify or transmit the precise location of your vehicle.

If you wish, you may be able to disable the use of precise location tools through your vehicle’s System Settings. By choosing “Listen now,” “PROCEED TO USE,” or similar, you consent to SiriusXM having access to aggregated and anonymized precise location data until you take action to disable the Geo-Location tools.

Access and Update Your Information: We give you access to a broad range of information about your account and your interactions with us in the “My Account” portion of siriusxm.ca. You may also have access to the foregoing by contacting customer care by phone (1-888-539-7474) or email (care@siriusxm.ca). You are responsible for updating and maintaining the truth and accuracy of the personal information you provide to us.

6. Storage of Personal Information

Personal information may be stored in Canada or with our Affiliates and Service Providers in Canada and the United States, where it will be subject to the legal regimes of those jurisdictions and may be disclosable to others as required by local laws, including to government, law enforcement, or participants in court proceedings. Personal information may be accessed by our Service Providers in countries including Canada, the United States, Morocco, Egypt, Tunisia and the Philippines.

To help protect the confidentiality of personal information, we use physical, administrative and technological safeguards appropriate to the sensitivity of the personal information being protected.

We use a combination of security measures to safeguard the confidentiality of the personal information you provide us. We have security procedures for the storage and disclosure of your personal information in order to prevent unauthorized access. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure, and it may be possible for third parties to intercept or access information unlawfully. We cannot guarantee the security of your or any other person’s information.

The Sites may contain links to other websites. Keep in mind that we do not control, and are not responsible for, the privacy or security practices or the content of these other websites.

We may retain your personal information for a limited period of time after you cease using our Sites or Services for purposes of internal account management, to resolve disputes, enforce our Customer Agreement, technical and legal requirements and constraints related to the security, legal compliance, integrity and operation of the Sites and the Services.

7. Changes to this Privacy Policy

SiriusXM reserves the right to modify or supplement this Privacy Policy statement at any time by providing you with notice of the change. Notice includes but is not restricted to posting a link to the new Privacy Policy, posting a new Privacy Policy at siriusxm.ca/privacy-policy, or sending you a link to the new Privacy Policy via contact information you have provided to us. Please read any such notice and the new Privacy Policy statement. Such change will be effective with respect to your use of the Sites and the Services after SiriusXM has given notice of the change.

Your continued use of the Sites and the Services after we post such notice will constitute your acceptance of the new terms and their application to your use of the Sites and the Services. Information disclosed to us, including information previously furnished to us, will be treated as if any changes to this Privacy Policy formed the initial terms.

8. Jurisdiction

SiriusXM is a federally regulated entity in Canada. We only make our Services available to persons located in Canada and our Sites are intended for use and viewing in Canada only and by Canadian residents only. We do not intend to collect, and we do not knowingly store personal information from consumers or users who are residents of countries outside of Canada. We may collect anonymous information associated with a device in order to limit extraterritorial distribution of our Services, but we do not associate such information with a device owner or residency of any particular country.

As a result, this Privacy Policy is intended to comply with and should be interpreted in accordance with the federal privacy laws of Canada. We do not represent or warrant that the Sites are appropriate for use in any particular jurisdiction. Those who choose to access the Sites or use our Services do so at their own initiative and are responsible for complying with all applicable laws, rules and regulations.

DEFINITIONS:

360L: The Services we provide to certain radios (often referred to as “360L radios”) utilizing a combination of the SiriusXM satellite network and a wireless Internet connection.

Affiliates: Sirius XM Radio Inc. and its subsidiaries.

Customer Agreement: Subscribers to our Services are also subject to our Customer Agreement. Any terms used and not defined in this Privacy Policy have the meanings set forth in our Customer Agreement and our Website Terms of Use, if defined there.

Enabled Radio: These are SiriusXM radios which have an ability to receive radio content and transmit information via the modem installed in the vehicle, including radios currently known as 360L models. Radios that are not 360L are not enabled and DO NOT transmit personal information as described in this Privacy Policy.

Geo-Location: In connection with a radio, information about the precise location of a radio. In connection with Listener Usage Data, information about the precise geographical location of an Enabled Radio, app, or entertainment product which incorporates SiriusXM technology.

Internet-Enabled Device: A device used to listen to our Services via the Internet, including desktop computers and mobile devices. Internet-Enabled Devices also include Enabled Radios in vehicles.

Listener Usage Data: Information about the usage of a Sirius, XM, SiriusXM, or other radio, app, navigation, information or entertainment product, which incorporates SiriusXM technology or accesses SiriusXM content, including which content is listened to or watched. Examples are listening time, content, channel preferences, downloads, Tune Starts, pause, time of day use, On Demand use via the SiriusXM app, marine or aviation weather data services used, driving patterns and conditions, as well as videos viewed and duration of viewing.

Rough Location: means your general location as inferred through your IP address.
Service(s): means our trial, paid, ad-supported or other subscriptions to our SiriusXM satellite radio service, SiriusXM Streaming, and any other service we offer through Enabled Radios or any other technology through which our services can be accessed, traffic, weather (including marine and aviation), data and infotainment, and any other Sites, players, widgets, tools, applications, data, software, APIs and other services provided by SiriusXM (collectively referred to as our “Service(s)”)

Service Provider: An Unaffiliated third-party company that performs various services or functions on SiriusXM’s behalf. These third parties have access to your personal information only to the extent necessary to perform the functions they carry out on our behalf.

“SiriusXM”, “we”, “our” or “us”: refers to Sirius XM Canada Inc.

Site or Sites: Websites operated by or on behalf of SiriusXM, as well as our online media player, our mobile applications (the SiriusXM apps for mobile devices), Enabled Radios (including those enabled with 360L), and any other technology through which our Services can be enjoyed such as third-party hardware for the home, applications, and radios.

Streaming: Delivery of the SiriusXM Services through the Internet or mobile networks as opposed to a SiriusXM satellite radio receiver.

Unaffiliated: Companies or individuals that are not affiliates of SiriusXM, such as retail stores and websites owned and operated by merchants on which advertisements for SiriusXM products or services may appear.

User Content: Any material submitted to SiriusXM or posted to the Sites or third-party sites by users through social media or other means.

Vehicle Radio Usage: Information about an identified or identifiable individual’s interactions with an Enabled Radio in a particular vehicle, including Listener Usage Data.
You: Visitors to or users of a Site or our Service.
